What is a Felony?

In Illinois, felonies are the type of crimes which are punishable by a term of one year or more in state prison or by the death penalty. On the other hand, misdemeanors (considered less serious crimes) are punishable by less than a year in county jail. Murder is punishable by the death penalty, life imprisonment, or a prison term of four to 100 years.

Felony Classifications

Illinois law includes the following five felony classifications:

Class X Felony

• Prison sentence: six to 30 years
• Fines up to $25,000
• Examples: aggravated criminal sexual assault, aggravated battery of a child, and armed robbery

Class 1 Felony

• Prison sentence: four to 15 years
• Fines up to $25,000
• Examples: criminal sexual assault, possession of heroin or cocaine, and theft in the amount of $10,000 to $100,000

Class 2 Felony

• Prison sentence: three to seven years
• Fines up to $25,000
• Examples: arson, aggravated battery of police officer, drug possession of 2000 grams of marijuana, and theft of $2,000 to $10,000

Class 3 Felony

• Prison sentence: two to five years
• Fines up to $25,000
• Examples: forgery and retail theft over $300

Class 4 Felony

• Prison sentence: minimum of one year
• Examples: DUI, stalking, drug possession of 30 grams of marijuana
