How Does the State Prove a DUI Charge in Illinois?

In order to convict you of driving under the influence, the state must prove that you were driving or in control of a vehicle while under the influence of alcohol or drugs. In Illinois, you are considered to be under the influence if your ability to drive is impaired to the slightest degree. However, the state must also prove that you were operating a motor vehicle, snowmobile, all-terrain vehicle (ATV), watercraft, aircraft, or streetcar while under the influence.

Under Illinois law, you are considered to be in control of a vehicle if you are sitting behind the steering wheel, even if the vehicle is not in motion. Additionally, you are still considered to be in control of a vehicle if you are physically unable to operate the vehicle due to intoxication, even if you are not behind the wheel.

What Are the Penalties for a DUI Conviction in Illinois?

If you are convicted of driving under the influence, you may face harsh penalties, including the loss of your driver’s license and increased insurance rates. Additionally, if you are convicted of a first-time DUI, you may also face mandatory jail time, fines, and community service. If you are convicted of a second DUI, you will face more severe penalties, including increased jail time and license revocation.

The penalties for a DUI conviction will increase with each subsequent conviction. For example, a third DUI conviction will result in a Class 2 felony charge, which carries a prison sentence of up to 5 years and a fine of up to $25,000.
