The penalties for identity theft depend on the amount of money or property involved in the crime:

  • Less than $300 – Class 4 felony, punishable by a maximum prison sentence of three years and a fine of up to $25,000
  • Between $300 and $2,000 – Class 3 felony, punishable by a maximum prison sentence of five years and a fine of up to $25,000
  • Between $2,000 and $10,000 – Class 2 felony, punishable by a maximum prison sentence of seven years and a fine of up to $25,000
  • Between $10,00 and $100,000 – Class 1 felony, punishable by a maximum prison sentence of 15 years and a fine of up to $25,000
  • More than $100,000 – Class X felony, punishable by a maximum prison sentence of 30 years and a fine of up to $25,000
