Many people use fake identification (ID) to commit some sort of crime,
whether they are kids who want to drink before they’re of legal
age or people who want to commit fraud. Whatever the case may be, it’s
illegal to obtain, distribute, or use a fraudulent state ID card or driver’s license.
If you are caught using a fake ID, you can absolutely be arrested for the
crime and could face a Class A misdemeanor or Class 4 felony charge. A
misdemeanor charge is punishable by up to 1 year in jail, and a felony
charge is punishable by 1 to 3 years in jail.
Likewise, you could be fined anywhere from $2,500 to $25,000 depending
on the circumstances. The state of Illinois also has the right to suspend
or revoke driving privileges even if you aren’t convicted of having
a fake ID.
Illinois has particularly harsh laws regarding fake ID use. However, it’s
incredibly rare for 1st-time offenders to be sent to jail or even arrested. Younger individuals
might be punished with 50 hours of community service and a suspended license,
but older individuals, especially those with a criminal record, are more
likely to be punished more severely.
